Lawsuit Filed Against Forney Daycare Center After 6-Year-Old Suffers Foot Fractures

The parents of a 6-year-old girl are suing Primrose School ofForney at Gateway after their 6-year-old daughter fractured her foot in three places during a playground incident that the family says was entirely preventable.

Austin Baxter and Amy Centeno claim the daycare center was negligent and broke state childcare laws on July 24, 2024, when their daughter was allowed to jump from a 7-foot-high playground railing at the daycare center and landed in such a way, it broke her foot. The complaint states that surveillance footage captured two caregivers sitting at a picnic table on the playground, one with their back to the playground and the other distracted by an iPad. Instead of intervening to prevent the unsafe action, they allowed their attention to be elsewhere.

The lawsuit alleges that another student had to help the couple's daughter over to the caregivers who were seated 15 feet away from the incident, because neither noticed what occurred.

“Our daughter was seriously hurt and left unattended in pain,” says the girl's mother, Amy Centeno. “No parent should have to wonder if their child is being watched at a daycare center. They are supposed to be kept safe, but that clearly didn't happen.”

The complaint also claims that the daycare center attempted to cover up the incident. The accounts that the caregivers gave state investigators contradicted statements from the multiple children who witnessed what happened, with kids saying caregivers did not warn the girl or her classmates about jumping from the railing. The caregivers even changed their own accounts, undermining their credibility, per the complaint.

An independent state investigation into the incident cited Primrose School of Forney for five different safety failures that broke state childcare laws.
