On August 14, 2025, the Securities and Exchange Commission sued Wear, Water Station, and Creative in the U.S. District Court for the Southern District of New York for violations of the federal securities laws arising from a Ponzi scheme operated by Wear through Water Station and Creative, two entities that Wear formed and controlled. According to the lawsuit, more than 250 investors were impacted.

Separately, the SEC sued Chirico for breaches of fiduciary duties to an institutional client in violation of the federal securities laws.

Also on August 14, 2025, the U.S. Attorney's Office for the Southern District of New York announced the filing of criminal charges against both Wear and Chirico stemming from the alleged Ponzi scheme.
