According to the lawsuit filed, Adobe Veterinary Centers, LP allegedly knew of Plaintiff’s medical disabilities and need for medical accommodations. Plaintiff met with management to discuss the accommodations, which resulted in Adobe Veterinary Centers, LP denying the good faith request for medical accommodations and placing Plaintiff on medical leave without notice. Adobe Veterinary Centers, LP later on, allegedly, wrongfully terminated Plaintiff. Within the State of California there exists a substantial and fundamental public policy, set forth in the California Government Code §12900, which forbids age and/or medical condition harassment/discrimination, retaliation, and wrongful termination.
Additionally, Adobe Veterinary Centers, LP allegedly failed to provide employees with legally required meal and rest breaks. Specifically, employees were allegedly required from time to time to work in excess of four (4) hours without being provided ten (10) minute rest periods. The applicable California Wage Order requires employers to provide employees with off-duty rest periods, which the California Supreme Court defined as time during which an employee is relieved from all work related duties and free from employer control.
