Club Demonstration Services, Inc., an in-store marketing provider for Costco, allegedly failed to accurately provide employees with legally required meal and rest breaks. This also, allegedly, contributed to missed meal break penalties for employees.
The San Francisco employment law attorneys, at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action complaint alleging that Club Demonstration Services, Inc. violated the California Labor Code. The Club Demonstration Services, Inc. class action lawsuit, Case No. 25CECG01577, is currently pending in the Fresno County Superior Court of the State of California. A copy of the Complaint can be read here.
The lawsuit alleges Club Demonstration Services, Inc. failed to provide employees with legally required meal and rest breaks. Specifically, employees were allegedly required from time to time to work in excess of four (4) hours without being provided ten (10) minute rest periods. The applicable California Wage Order requires employers to provide employees with off-duty rest periods, which the California Supreme Court defined as time during which an employee is relieved from all work related duties and free from employer control.
Additional allegations include Club Demonstration Services, Inc. failing to reimburse employees for required business expenses. California Labor Code Section 2802 expressly states that “an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties…” During employment, Plaintiff and other California Class Members were allegedly required to use their personal cellular phones as a result of and in furtherance of their job duties.
